These Terms govern the use of TaxiST.app, a technology platform operated by C-Wave International d.o.o. TaxiST.app connects riders with independent drivers and transportation providers. TaxiST.app does not provide transportation services itself.
1. Operator details
The Platform is operated by C-Wave International d.o.o., Ulica gardijskih brigada 52, 21217 Kaštel Stari, Republic of Croatia, OIB: 20817300177. Contact: support@taxist.app .
2. Acceptance of Terms
By accessing TaxiST.app, creating an account, using the website, Android application, QR ordering pages, rider tools, driver tools, support tools or any related feature, the user accepts these Terms. If the user does not agree with these Terms, the user must not use the Platform.
3. Nature of the Platform
TaxiST.app is a digital technology platform. It enables communication, ride requests, QR vehicle pages, estimated route and price information, driver profiles, ratings, support and related digital tools. TaxiST.app does not provide transportation services, does not operate taxi vehicles, does not employ drivers and does not act as a carrier.
4. Independent drivers
Transportation services are provided exclusively by independent drivers or transportation providers. The transportation relationship is concluded directly between the rider and the driver. Drivers are responsible for all licences, permits, insurance, vehicle condition, legal taxi authorisations, tax obligations, pricing rules and compliance with applicable Croatian and EU regulations.
5. Eligibility and accounts
Users must have legal capacity to use the Platform and must provide accurate, complete and current information. Users are responsible for maintaining the confidentiality of login details and for all activity under their account. TaxiST.app may request verification or documentation where reasonably necessary for security, legal or operational reasons.
6. Rider obligations
Provide accurate pickup, destination and contact information; use the Platform only for genuine ride requests; behave respectfully toward drivers and support staff; pay the driver directly where a ride is completed; comply with applicable laws and safety rules.
7. Driver obligations
Hold all licences, permits and insurance required for lawful transportation services; keep vehicle, fare and profile information accurate; provide transportation services safely and professionally; comply with tax, accounting, consumer, transport and data protection obligations applicable to the driver;not misuse rider data obtained through the Platform.
8. Ride requests and QR ordering
A ride request is a digital request only. Drivers may accept, reject or cancel a request according to availability and lawful business reasons. QR vehicle pages may allow a rider to request a specific vehicle, but QR scanning does not guarantee availability, acceptance, arrival or completion of a ride.
9. Estimates, routes and arrival times
Prices, distances, routes, travel times and arrival times shown on the Platform are estimates. They may change because of traffic, waiting time, GPS accuracy, route changes, detours, local pricing, driver settings or other circumstances. TaxiST.app does not guarantee the accuracy of estimates.
10. Payments
Transportation payments are arranged and settled directly between rider and driver. TaxiST.app does not process transportation payments and is not a payment intermediary for transportation services. Paid driver plans, premium features or other digital services purchased from TaxiST.app are separate platform services supplied by C-Wave International d.o.o.
11. Premium driver plans
TaxiST.app may offer paid or free driver plans, including premium options. Plan features, duration, availability and prices may be changed prospectively. Unless mandatory law provides otherwise, digital platform features begin when access is activated. Non-payment, misuse or breach of these Terms may result in limitation or suspension of premium features.
12. Advertising and third-party content
The Platform may display advertising, including Google AdSense or other third-party advertising technologies. Advertisements and third-party links are not endorsements by TaxiST.app. Users should review applicable third-party terms and privacy information.
13. Messaging, support and notifications
The Platform may enable rider-driver messages, support tickets, email messages, push notifications and operational alerts. Users must not send unlawful, abusive, misleading, discriminatory, threatening, spam or harmful content. TaxiST.app may review, restrict or remove communications where necessary for security, support, abuse prevention or legal compliance.
14. Location data
The Platform uses location information to show pickup points, nearby vehicles, driver movement, route estimates and ride status. GPS and map data may be inaccurate or unavailable. Users must not rely on the Platform as the sole source for emergency, safety-critical or legally required navigation information.
15. Ratings and user content
Users may provide ratings, comments or other content. Such content must be truthful, lawful and respectful. TaxiST.app may remove content that is abusive, defamatory, false, irrelevant, discriminatory, spam, unlawful or harmful to platform integrity.
16. Prohibited use
Fake ride requests or fraudulent accounts; harassment, threats or discriminatory behaviour; attempts to bypass security, abuse APIs or overload the Platform; unauthorised copying, scraping or reverse engineering; use of the Platform for unlawful transportation or other unlawful purposes.
17. Suspension and termination
TaxiST.app may suspend, restrict or terminate access where a user breaches these Terms, creates security or legal risk, abuses the Platform, provides false information, fails verification, does not comply with driver obligations or where required by law or competent authority.
18. Intellectual property
TaxiST.app software, design, database structure, trademarks, logos, graphics, texts and platform content are owned by or licensed to C-Wave International d.o.o. Users receive only a limited, revocable, non-transferable right to use the Platform according to these Terms.
19. Data protection
Personal data is processed according to the Privacy Policy, Cookie Policy and GDPR Rights page. By using the Platform, users acknowledge that the Platform must process certain personal data, including account, ride, location, communication and technical data, to provide the service.
20. Limitation of liability
To the maximum extent permitted by applicable law, TaxiST.app is not liable for transportation services, driver conduct, rider conduct, vehicle condition, accidents, injuries, property damage, lost items, delays, cancellations, incorrect estimates, GPS errors, third-party services, network outages or indirect losses. Nothing in these Terms limits liability where such limitation is prohibited by mandatory law.
21. Indemnity
Drivers and users agree to hold TaxiST.app harmless from claims, damages, penalties, costs or expenses arising from their unlawful conduct, breach of these Terms, incorrect information, misuse of the Platform or, for drivers, failure to comply with transportation, tax, licensing, insurance or consumer obligations.
22. Consumer complaints
Users may submit complaints by email to support@taxist.app or by post to the registered office. TaxiST.app will confirm receipt and respond within the period required by applicable Croatian consumer protection rules, generally within 15 days where applicable. Transport-service complaints should primarily be directed to the driver providing the service.
23. Governing law and disputes
These Terms are governed by the laws of the Republic of Croatia, without prejudice to mandatory consumer protection rights that may apply under EU law. The parties will first try to resolve disputes amicably. Where no amicable solution is reached, competent courts in Croatia shall have jurisdiction unless mandatory law provides otherwise.
24. Changes to Terms
TaxiST.app may update these Terms to reflect legal, technical, business or operational changes. The latest version will be published on the Platform. Continued use after publication means acceptance of the updated Terms, unless mandatory law requires another form of notice or consent.
